Ian McKenna is an experienced litigator with over 25 years’ experience of litigating and arbitrating insurance and reinsurance disputes on behalf of clients in the London and international insurance markets. He has been consistently recognised for many years as a leading lawyer in contentious reinsurance, including Band 1 recognition by Chambers Global and Chambers UK and by Super Lawyers and the Legal 500.
Ian has litigated and arbitrated disputes in London, the United States, Bermuda, Australia, Kuwait and various European jurisdictions including France, Germany and Denmark.
He has litigated and arbitrated disputes arising from significant market losses including Exxon Valdez, WTC and 9/11, film finance, HS Weavers, Transit Casualty, Hurricanes Katrina/Rita/Wilma, asbestos/mesothelioma, the California bushfires and subprime mortgages/Madoff. Most recently Ian has been arbitrating disputes under ILW contracts arising from Deepwater Horizon and Costa Concordia.
Ian is also active in the ILS market advising clients on sidecars, collateralised reinsurances, cat bonds and ILW’s on trigger and automatic commutation/release of collateral provisions.
He has advised on general commercial documents used by insurers and reinsurers such as underwriting guidelines , broker TOBA’s, outsourcing agreements, agency agreements, delegated underwriting agreements, claims manuals and he has conducted and advised on claims audits and inspections of records. He has also litigated disputes arising from the poaching of brokers on issues such as notice periods, non-solicitation agreements and the entitlement to brokerage/commission.
Ian has extensive experience of advising on reinsurance run-off strategies including schemes of arrangement, commutation agreements, reinsurance recoveries and Part VII business transfers. He has advised extensively on insolvency-related issues arising from underwriting pools and brokers and was also the legal advisor on a number of high-profile solvent schemes of arrangement.
Ian has also advised on and litigated brokers’ e&o disputes and on disputes arising from the operation of insurance/reinsurance pools and captive insurers.
