Biography
Ivan Pearce is described as a “meticulous junior destined for the very top”, according to the 2008 edition of Chambers Directory. He has a particular expertise in fraud and business related offending. He has appeared in a number of leading cases in the confiscation field including R v May and others before the Court of Appeal and the House of Lords.
He has represented both defendants and prosecuting and regulatory authorities in litigation abroad including the Turks and Caicos Islands, Spain, Austria and the United States of America. The same edition of Chambers Directory notes “his practice centre’s around money laundering, asset forfeiture and confiscation. He appeared in R v Rigby and Bailey at the Court of Appeal in a case where defendants faced confiscation proceedings based on the increase in share price generated by misleading statements made to the market. Recent cases include defending in a number of carousel VAT frauds and SFO v Kent Pharmaceuticals concerning allegations of cartel behaviour by generic manufacturers of penicillin and warfarin.
He is often called upon to provide advice to professionals, institutions and private companies at the early stages of investigations by regulators and prosecution authorities.
He is a contributing author to Smith Owen and Bodnar on Asset Recovery (Oxford University Press) and the Anti Money Laundering Guide (CCH Publications). He has lectured extensively on topics such as Money Laundering, the Proceeds of Crime Act, Confiscation and Restraint and Freezing Orders generally.
