His civil practice comprises claims under the Inheritance Act 1975, contentious probate, proprietary estoppel, constructive trusts, property disputes, costs issues and claims arising in contract, negligence and misrepresentation. Recent trials and appeals have involved the Inheritance Act, presumptions in lost will cases, testamentary capacity, constructive trusts, contract, fraudulent claims in road traffic accidents, estate agents’ commission and cross claims for adverse possession of unregistered land. He was junior counsel for the appellants in Soulsbury v Soulsbury. He also appears before the Lands Tribunal, Court of Protection and at Coroners’ inquests. He is a regular speaker at Chambers and external seminars.
In family Mark specialises in matrimonial finance, claims under the Trusts of Land and Appointment of Trustees Act 1996, Schedule 1 of the Children Act 1989 and Schedule VII of the Family Law Act 1996. He also deals with Injunctions, Committals and all nature of applications under S8 of the Children Act 1989.
He is a Member of PIBA, PNBA and FLBA.
