Stephen Smith is a leading silk who specialises in litigating high-value, complex commercial disputes. He is particularly sought-after for cases involving jurisdictional issues and restraints on the disposals of assets (including freezing orders and interim relief). Notable cases include Derby v Weldon, the BCCI liquidation, proceedings arising out of the collapse of the Maxwell Empire, Trustor v Smallbone, Alfa Telecom v Cukurova and the Rastogi litigation.

Since 2009 Stephen has been the lead advocate in the complex fraud and asset recovery proceedings known as JSC BTA Bank v Ablyazov, in which over 60 leading decisions have been given so far (including 12 in the Court of Appeal), and judgment has been obtained for over $3.7bn.

Stephen also has a successful offshore practice and regularly appears in the courts in the Eastern Caribbean, the Bahamas, the Isle of Man and the Cayman Islands; and he has advised in connection with cases proceeding in Bermuda and Hong Kong. Stephen has appeared before the Privy Council on 10 occasions.
