This podcast aims to give an overview of the circumstances under which a court may disqualify a director for a breach of competition law. It looks at the conditions which must be satisfied for a court to make a CDO, the breaches of competition law that the legislation provides for and the penalties of non-compliance. It also considers who has the power to apply for a CDO and looks at the factors the OFT will take into account. Finally, the podcast looks at similar provisions in other jurisdictions.
