In this CPDcast Professor Harry Rajak from the University of Sussex, provides a detailed overview of the EC regulation on insolvency proceedings. He sets out the nature of the Model Law on Cross-Border Insolvency which was prepared and published by UNCITRAL and the importance of drawing a distinction between procedural harmonisation and substantive harmonisation in insolvency proceedings.
