Course Aims:

This podcast is aimed at those who work in construction or are involved in mediation. It aims to discuss some of the findings of the TCC’s survey on the use of mediation in cases before it. The podcast will discuss the growth in mediation as a dispute resolution tool in the last 15 years or so and what benefits it can bring for settlement and construction projects.

Outcomes:

  • Understand what ‘project mediation’ is and what role it plays in construction;
  • Understand the approach taken towards mediation by the CPR and the mainstream court system;

The subject of this podcast is a groundbreaking new study conducted by Kings College London and the Technology Construction Court on the use of mediation in construction disputes. This is one of the most comprehensive studies on the use of mediation undertaken in the UK and practitioners in the area may consider its findings useful in how they approach disputes in which they are involved.
