This podcast will provide listeners with an introduction to the sources of a shareholder's rights as well as examining the various forms of litigation available to a shareholder to enforce those rights. Listeners will come to understand the requirements of each type of proceedings, the remedies available and the practical issues to be considered in advising a client as between the different forms of relief.

The podcast looks at a number of types of shareholder proceedings, including unfair prejudice applications under section 994 of the Companies Act 2006, just and equitable winding up applications under section 122(1)(g) of the Insolvency Act 1986, the new statutory derivative claim procedure under section 260 of the Companies Act 2006 and the ability of shareholders to bring claims as an exception to the rule in Foss v Harbottle.
