Course Aims:

This podcast aims to review the work and practices of the Tax Tribunal and Upper Tribunal since they began their work in April 2009. It will discuss the workings of the new unified system uniting direct and indirect tax disputes, the track and case management systems, pre-hearing steps to dispute resolution and appeals.

Outcomes:

  • Understand the origins of the current tribunal structure;
  • Be aware of the new procedures and tracks to which cases are assigned;
  • Understand the ways in which the treatment of cases has been unified and in what areas differences remain;

  • Be aware of the issue of privacy for tax payers seeking to challenge HMRC;
  • Understand the role of LSS and ADR in the framework for how disputes are dealt with;
  • Understand the appellate and judicial review function of the tribunal and how these functions work in practice.
