Course Aims:

This podcast aims to introduce listeners to third party funding as a means to allow a civil claim to be brought. With litigation costs sky-high and a lack of liquidity, claimants are looking for someone to bankroll their claim. It will discuss how the mechanics of the funder-claimant-lawyer relationship works, what approach third parties take to backing litigation and what changes are in the air following Lord Justice Jackson’s Cost Review in 2010.

After completing the course you will:
  • Understand what third party funding is and its place in facilitating civil litigation;
  • Be aware of the proposed changes to the third party funding market following Jackson’s proposals;
  • Understand the relationship between third party funding and ATE insurance;
  • Understand the approach third party backers take to a claim when approached for funding;
  • Understand the risks and benefits in having a third party backer for litigation;
