This CPDcast aims to examine the obligation of employers to inform and consult employees when a TUPE transfer is taking place. It will examine key statutory provisions and also recent case law.
In this CPDCast, Stephen Levinson examines the obligation of employers to inform and consult employees in the event of a TUPE transfer, namely how employers can comply with this obligation. The obligation the podcast examines stems from Chapter III, Article 7, of Council Directive 2001/23/EC which in turn is a consolidation of Directive 77/187/EC and its subsequent amendments. The implementation of Article 7 is now contained in Regulations 13, 14 and 15 of The Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006 No. 246).
